Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DataForge API platform, documentation, and related services (collectively, the "Service"), provided by COCIS ANDREI DORIN PERSOANĂ FIZICĂ AUTORIZATĂ ("DataForge", "we", "us", or "our"), an authorized natural person (PFA) registered in Romania, having its registered office at Sat Mărișelu, Comuna Mărișelu, Strada Învățător Gavril Hordoan, Nr. 14, Jud. Bistrița-Năsăud, România, Unique Registration Code (CUI): 54282580, Trade Registry Number: F2026014593002.

By accessing or using the Service, or by clicking "I Agree" during the subscription process, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

1. Description of Service

DataForge provides a Data-as-a-Service (DaaS) gateway offering programmatic access (via REST API) to consolidated public records and compliance databases, including but not limited to NANDO, FDA, RAPEX, GOTS, and OEKO-TEX (the "Data").

2. API Usage and Restrictions

  • License: Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the API for your internal business purposes. Exception: Customers subscribed to the Enterprise SaaS tier are explicitly granted commercial redistribution and data resale rights, provided the Data is integrated into their proprietary software platforms.
  • API Keys: You will be issued a unique API key. You are strictly responsible for maintaining the confidentiality of your API key and for all activities that occur under your account.
  • Prohibited Conduct: You shall not: (a) share, sell, or transfer your API key to any third party; (b) attempt to reverse engineer, disrupt, or compromise the integrity of the Service; (c) bypass or attempt to bypass any rate limits or security mechanisms; (d) use the Data for any illegal purposes.

3. Data Source Disclaimer and Limitation of Liability (CRITICAL)

  • "As Is" Basis: The Data provided through the Service is aggregated from third-party public governmental and organizational registries. DataForge provides this Data strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.
  • No Legal Advice: DataForge is an engineering tool, not a legal or compliance advisory service. We do not guarantee the accuracy, completeness, or timeliness of the Data.
  • Limitation of Liability: In no event shall DataForge be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to financial losses, supply chain disruptions, regulatory fines, or loss of profits arising out of your reliance on the Data provided by the API.

4. Payments and Subscriptions

  • Billing: Access to the Service is billed on a subscription basis via our authorized payment processor (Stripe). You agree to provide accurate billing information.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date.
  • Refunds: Due to the digital nature of the API, all payments are non-refundable unless otherwise required by mandatory law.

5. Termination

We reserve the right to suspend or terminate your API access immediately, without prior notice, if you breach these Terms (including failure to pay fees or exceeding fair use limits).

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in Bistrița-Năsăud, Romania.
